Agreements create a confidential relationship between Bordes Design and their clients. Information concerning Bordes Design and their clients business affairs, vendors, finances, properties, methods of operation, computer programs, employees, documentation, and other such information whether written, oral, or otherwise, is confidential in nature. and their clients and employees of both will adhere fully to this confidentiality agreement.

Governing law:
Agreements shall be binding upon the heirs and assigns of the parties and shall be governed by and interpreted according to the laws of the State of Maryland.

Entire agreement:
Agreements represent the full understanding between the parties and there is no other agreement, oral or written, between them, and that these agreements may not be modified without an agreement in writing signed by the party to be charged. This contract is in effect until written notification of termination from either party. Bordes Design is only responsible for the written details within a proposal, invoice, contract, email or similar written communication of any project. Any additional scope of work must be agreed to by some form of written communication or Bordes Design will not be responsible for completing additional items.

Deposits will activate the beginning of work for the client and will indicate that the client has read and agreed to the terms put forth by Bordes Design on this page as well as the terms on any presented documents.

All images will be supplied to Bordes Design or purchased by Bordes Design from a Stock Photography source for an additional fee.

All copy will be supplied to Bordes Design by the client. Bordes Design is not responsible for any spelling, punctuation or grammatical errors.

Abandoned Projects:
All projects must be paid for in full unless otherwise stated within 30 days of completion. If payment is not received Bordes Design retains the rights to the project files and the files may remove them from their storage area. If a client is unavailable for contact with an open project for more the 90 days, the project and contract will be void.

Clients agree to non- competition regarding their respective customers. Neither company will attempt to take any customers from the other company for any reason whatsoever. Any client information will be kept confidential between the companies and will be used for the sole purpose of performing the contractual services as herein defined in this document.

Source Files:
Printed Materials and Copyrights: Clients may request all source files (except for our "free site " package and mobile websites). No royalty fees will need to be paid to Bordes Design for their use. Bordes Design is not responsible for the posting of any copy, images, photographs, logos and other related material sent to Bordes Design. Bordes Design does not guarantee and printed material created by another company or brand.

Agreement Timeout:
Clients are responsible for supplying all needed content to complete any project within 90 days of the start of a project. If a client does not provide the full content within this time, clients will incur a late fee of 10% and will be given an additional 30 days to supply the rest of the content. If a client does not supply the content, then the contract agreement between the client and Bordes Design will become void with no refunds.

Bordes Design will not be responsible for any errors or omissions in the Pricing or information provided before an order is paid for. Nor for any loss or damage caused by your reliance on information obtained on this site or email. References to third-parties, their products, and/or services does not imply endorsement by Bordes Design thereof. This site may contain technical inaccuracies or typographical errors. Changes are periodically added to the information herein; these changes will be incorporated in updates of the site. Bordes Design may make improvements and/or changes in the product(s) and/or the program(s) described in this site at any time without notice.

Final Payment:
The approved final web site will be uploaded and live at the designated domain name immediately following the payment of the project balance. If a web site is made "live" with the understanding a payment will be made, Bordes Design reserves the right to remove a clients web site from the "live" status if payment is not received.

Additional Changes:
Bordes Design will allow a time of 5 business days after the new site has been uploaded to the designated URL for the client to notify Bordes Design of any Minor Changes that need to be completed. These updates will be done for no charge but cannot exceed 4 working hours by Bordes Design.

Any payments for website work, domain names, hosting, misc. projects, etc. not received can result in service interruption and additional reactivation fees.

Transfer of Hosting, Website and Domain Names:
Transferring of hosting or domain names to another party will have a fee of $99. If hosting is begun with Bordes Design, Bordes Design is not responsible for any files running on other platforms. Bordes Design does not guarantee 100% interruption free hosting as server space is provided by an outside company. Bordes Design is not responsible for website functionality when transferred to another hosting company.

E-mail Accounts:
Email accounts are not guaranteed. Interruption and loss of emails while unlikely is possible and not the responsibility of Bordes Design. It is recommended to backup all important emails due to unlikely but possible account problems resulting in the loss of information. We recommend backing up all emails with a third party such as Gmail. We offer assistance with this process when requested.

Late Fees:
Any late payments for services rendered will have notified late fee associated with them.

Service Requests:
Bordes Design reserves the right to reject any new service proposals from clients whom they feel will not be a good fit for their company and employees. Additionally, Bordes Design may be unable to take on additional work at certain times due to resource and time availability.

Your Invoice Will State:
PRICING: All pricing is subject to change based on client's needs. Unused maintenance time does not rollover to the next month.

DESIGN: Up to 3 minor revisions including placement of images, colors, text, etc. will be done after initial look and feel has been agreed upon.

IMAGES: All images need to be provided by the client in digital format unless project agreement states differently. Professional photography can be purchased for an additional fee.

COPY: All copy for web site must be provided by the client in a digital, finalized format. (Word Document)
TERMS: Please refer to Bordes Design terms of agreement @ Any deposit for work will be considered and agreement of these terms. Hosting & Domain Names are not included unless project agreement states differently. Any additional changes or updates including design, content, editing, additional pages etc., after client has signed off on approved work can result in additional fees depending on the work completed.
REFUNDS: All sales are final.
